A criminal battery and child endangerment investigation has been launched following reports that Gabriel Aubry, Halle Berry’s ex, allegedly pushed the nanny while baby Nahla was in her arms. Halle Berry has already arrived in court asking a judge to prohibit Gabriel from having any contact with their 3-year-old.

And before the alleged pushing, the nanny says Gabriel screamed at her and hurled a racial epithet. In addition, we’ve learned the L.A. County Dept. of Children and Family Services is also conducting a child endangerment investigation.

TMZ has learned more about what nanny Alliance Kamdem has told the cops. Law enforcement sources tell us … Kamdem claims Gabriel repeatedly yelled and cursed at her, often while Nahla was present. Kamdem also says it got so bad … Gabriel would make her sit in a corner in his condo until he called for her.

Kamdem also claims Gabriel often yelled at Nahla, causing the child to cower and cry. And she told police … when Nahla had a rash he refused to treat it. TMZ

Not to make light of child endangerment but the part where it says Gabriel made her sit in the corner is slightly ambiguous to where I’m just thinking he made the nanny sit in the corner. Though she was probably talking about Nahla.

The only way this story could be less horrendous is if he made her put on a dunce cap too. Because kids sitting in corners staring at the wall with a big cone hat on always makes me giggle.

Halle Berry went through an ugly separation with Gabriel Aubry where she called him a racist and he called her batsh*t crazy and had some emails to back it up. Well, looks like Oliver Martinez doesn’t read the tabloids because he proposed to Halle.

A rep for jewelry designer Gurhan tells PEOPLE that Olivier Martinez, Berry’s boyfriend of more than a year, has given her a diamond-and-emerald engagement ring.

Halle Berry turned 45 over the weekend and she celebrated by spending Saturday at Malibu beach in a bikini where her friend threw her in the ocean and wheelbarrowed her into a cluster of rocks. What kind of birthday celebration is this? Did they throw tacks in her bed too?

Back in February, Halle Bery and her ex, Gabriel Aubry, were said to have reached a truce over the custody battle of their 3-year-old daughter Nahla. Turns out that may have been a ruse to buy Halle’s lawyer some time to come up with a list of reasons Aubry is a bad father.

TMZ says a few minutes ago, Halle’s lawyer filed “a very thick stack of documents outlining trouble she’s had with Gabriel.” The documents “lists Gabriel’s failings as a dad.”

It would be cool if Halle was as crazy as people made her out to be and the document just looked like:

1. He’s an asshole
2. He’s an asshole
….

and so on until item 100 which calls Gabriel a “stupid asshole.”

A truce has been reached in the Halle Berry and Gabriel Aubry custody battle. If I’m understanding this correctly, Halle Berry will stop implying Gabriel Aubry is a racist baby abuser and Gabriel Aubry will stop implying Halle Berry is an overbearing, jealous and crazy bitch.

A source tells Radar she “started realizing that things were getting out of control. It was just getting too nasty and too public.” Halle will not seek sole custody of their daughter.

“Gabriel and Halle even resumed talking again last week, and it seems that Halle is going to be making it easier for Gabriel to spend time with Nahla, which has been a sticking point between the two up till now.

“Hopefully this is the start of the two of them being able to form some kind of workable co-parenting relationship for the sake of their daughter.

Childish name calling always devolves into angrily stomping around the room and crying for mommy so I kind of wanted to see where this was headed. But now they’re acting like civilized adults. Pfft. When has that ever solved anything?

A recent rumor popped up that Gabriel Aubry is insistent on people not calling his baby black, but white. People took this to mean he was a racist but maybe he just thinks his baby is mixed.

Whatever the case. Halle Bery feels differently. In an upcoming interview for EBONY magazine, Halle says her baby is black because of the one-drop rule. “I feel she’s Black. I’m Black and I’m her mother and I believe in the one-drop theory.” TMZ explains the one-drop rule was used during segregation to describe anyone who wasn’t 100% Caucasian.

Technically Halle Berry is only half-black. But if we were to follow the one-drop rule, you could apply it to everyone and because of evolution we’d be whatever color we started out as. Unless there’s a percentage rule to the one-drop theory. Like, if you’re less than 25% black, you’re not really black. I guess what I’m trying to say is don’t ever go up to the black kids at your school and tell them evolution means you’re black too and that makes you — in a baritone voice — “down with the brothas” because they’re going to laugh at you and might even kick your ass.

People are really taking this Gabriel Aubry is a racist story and running with it. A new report from TMZ says that Gabriel went nuts whenever anyone would call his daughter black. Because she’s not. Even though she’s 1/4 black. Mmm hmmm…

Sources connected with the former couple tell TMZ … whenever Gabriel would read a story about Nahla that referred to her as “black,” he would go off, insisting his baby was white. We’re told Gabriel would tell Halle and others they should demand a “retraction” when such references were made regarding his daughter.

The next story TMZ will run is how Gabriel paints his baby in whiteface instead of blackface and they’ll have a poll on which is more insulting. Then they’ll do a joke that goes “black people go like this and white people go like this!”

Yesterday, a source close to Gabriel Aubry claimed he was above leaking emails from Halle to the press because he has this thing called respect and would only present his evidence in a court of law where everything is kept private. Raise your hand. Who kept a straight face when reading that? No one? Good.

Because on Thursday, one of Halle Berry’s emails to Gabriel found it’s way to Radar. Allegedly, Halle said to him, “You were only good for one thing… Thanks for the donation.” Aw, snap. That’s cold. He had other talents too. I’m sure he made a good babysitter too. Or not. Halle supporters are implying he abuses Nahla.

The source later admits to Radar that Gabriel called Halle “a fucking bitch” but only because he was provoked and is adamant he never said the ‘N’ word.

They add that even then it was very rare for Gabriel to go off on Halle. “usually when she would call him and go crazy at him he would go silent and let her rant and rave then just ask her ‘are you finished now?’. I think that used to wind her up more than if he lost his cool with her, which, admittedly I know he did on a couple of occasions. But there’s no way he was ever abusive to her. It’s completely the other way around if anything!”

Although, one of Gabriel’s ex-girlfriends claims he used to spew racial slurs every so often and that she can’t believe he hooked up with Halle. The ex says Gabriel “has always been a borderline racist” and was “very disrespectful to women.” According to TMZ, the ex wants to reach out to Halle through mutual friends in the future to offer support. There we go. That’s the main reason for speaking out. To saddle up next to a celebrity and mooch off them. The number of fame whores in Hollywood never ceases to amaze me.

First came Halle Berry’s side claiming Gabriel Aubry is a racist baby abuser. Not in those exact words, but, you know, page hits. Now it’s Gabriel’s side’s turn to sling mud at Halle.

A source close to Aubry says he plans to take the high road and use the ammo he has to present his case at family court where details will be kept private. Of course, that didn’t stop the source from alluding to what Gabriel has. They say he has emails, texts and voicemails from Halle where she’s flying into angry and jealous rages.

“I honestly think Gabriel should release some of these messages he has from Halle, and tell his side of the story, but he won’t, he said he’s going to save them for family court, which will be a private, press-free environment,” the source told RadarOnline.com.

“I know it sounds like I’m painting a picture but Gabriel truly does not want to do anything at all that could potentially damage his daughter, and he knows attacking Halle in the press would ultimately do that.”

“She left a crazy message on Gabe’s cell just after some pictures came out of him at a Lakers game with a girl last year.

“She is mega, mega p***ed in the message, calling him, and the girl, all kinds of names – it’s certainly something Halle wouldn’t want heard. Gabriel played it to me at the time, and said: ‘see what I have to deal with?!’

“I really felt for the guy – I mean, he hadn’t done anything wrong….just gone on a date!

“He could totally do a number on her if he chose to – but he’s a nice guy at the end of the day and unlike Halle, Gabe’s not concerned with the public believing he is the ‘wronged one’ and with controlling his image – he is concerned with his daughter and her welfare.

“Perhaps if Halle spent more time truly worrying about that and less time worrying about how she’s being portrayed in the press the situation would be better and easier for all concerned.”

So, is Gabriel a money hungry, racist, unfit parent or is Halle a vindictive, jealous, over-controlling bitch? The truth probably lies somewhere in the middle. The very, very sexy middle of this Halle Berry/Gabriel Aubry custody battle sandwich. Rawr.

Halle Berry and Gabriel Aubry’s messy custody battle is getting even messier. Aubry’s former business partner Stephane Bibeau is siding with mommy on this one and tells PEOPLE, “Once they broke up he became verbally threatening to Halle. He is a vindictive guy.” Bibeau and other sources claim Aubry also hurled a racial slur at her.

TMZ adds on to the report saying Gabriel called Halle the “N” word (nagger?) and constantly called her other names like “f**king bitch” as well as sent her text messages using the same language. Probably just in case she forgot what he said. A source told TMZ, “He constantly demeaned her. It was awful.”

Saying Gabriel dropped “N” bombs elicits more gasps than accusing him of kicking his baby. Gabriel might as well tap out and hand the kid over at this point.

Halle Berry and Gabriel Aubry’s split was going well enough. Then Gabriel filed for custody of Nahla, their two-year-old daughter. Either to protect his rights as a father or to position himself to make a big crash grab. Sooner rather than later, a story came out about how Halle was crazy and was spying on Gabriel. Not a good sign for an amicable agreement.

Fast forward to today where E! says Halle had to pull out of a film production in New York due to a pending custody litigation. Her rep issued a statement on Monday. “She has attempted to resolve these custody issues amicably with her daughter’s father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.”

The statement continued, “Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her. Halle has always made the needs and safety of her daughter her first priority and, both while Halle and Gabriel were a couple and since their breakup, Halle has only acted in her daughter’s best interest.”

This could to mean Gabriel is an inept father who sucks at parenting or it could mean “you’ll have to rip this child support from my cold, dead hands.” This custody battle is gonna get messier than the time Christina Aguilera discovered cookie dough.

Earlier it was reported that Gabriel Aubry filed to be declared the father of his and Halle Berry’s daughter Nahla. Presumably to protect his rights as a dad and so he could see Nahla through a formal arrangement. Radar claims, however, that things are more sinister and that Gabriel was forced to file because Halle Berry is possessive and has even hired a pi to spy on him. She’s even gone as far as telling him who he can and can’t date.

“Basically whenever Gabriel doesn’t do exactly what Halle tells him to do, or if he does something she doesn’t approve of or like, she goes crazy on him, screaming and shouting,” the source says.

“Contrary to public perception Halle has a particularly nasty temper, and she can be really controlling and vindictive.

“I’ve been with him when he’s gotten these insane calls from Halle — with her screaming at him and going crazy, when the poor guy hasn’t done anything!”

The source says the couple’s troubles really came to a head towards the end of last year when Gabriel started dating other women. He was photographed out in public on dates and a number of magazines ran stories about him dating and enjoying the single life.

“Halle was absolutely furious and had a complete melt-down. She basically gave him an ultimatum — to choose between dating other women and carrying on being on her good side.

“Gabriel is one of the most laid-back, nicest guys that I know, but in the end he just got sick of being bossed around and told what to do by his ex-girlfriend.”

People always have to shatter the illusion of the perfect women for me. Halle is gorgeous but allegedly she’s also a psycho ex-girlfriend. If you happen to strike up a conversation with another woman one day, she’ll put a knife to your throat during sex and ominously tell you “I know what you did.”

Halle Berry and her ex, Gabriel Aubry have a two-year-old daughter together and since their breakup, they’ve seem to be on friendly terms. This is why it’s so surprising that a few weeks ago Gabriel filed for legal custody of their kid which could turn into a nasty custody battle.

Despite reports they split up on decent terms last spring, it looks Gabriel just wants to protect his legal rights. He filed a petition for joint physical and legal custody along with support.

As for why their five year relationship fizzled in the first place? Source told RadarOnline, “Gabriel felt it just wasn’t working any more. When they were first together, the nine year age difference between them didn’t phase him, she was the most beautiful woman he had ever dated and was totally in love.”

So the nine year age difference didn’t phase him until he noticed Halle looked older and older every day. Now he wants full custody and spousal support. This guy sounds like quite the catch. A prince among men. I’m surprised he didn’t wiggle the knife around after stabbing her in the back.
